H-2B Visa Cap Hit for FY 2025: What Employers Need to Know Now

As of March , 2025, the U.S. Citizenship and Immigration Services (USCIS) announced that it has received enough petitions to meet the H-2B statutory cap for the second half of fiscal year (FY) 2025. This cap is set at 33,000 visas for workers beginning employment between April 1 and September 30, 2025 . 

Key Points for Employers
•        Supplemental Visas: In addition to the regular cap, USCIS made available an extra 19,000 H-2B visas for returning workers for the early second half of FY 2025 (employment start dates from April 1 to May 14, 2025). This supplemental cap was also reached, with April 18, 2025, being the final receipt date for these petitions.
•        Cap-Exempt Workers: Employers can still petition for H-2B workers who are exempt from the cap, including:
o        Current H-2B workers seeking to extend their stay, change employers, or modify employment terms.
o        Workers who have already been counted against the cap in the same fiscal year.
o        Certain fish roe processors and workers in Guam or the Commonwealth of the Northern Mariana Islands. 
•        Planning Ahead: Given the high demand and quick exhaustion of the H-2B visa cap, employers are encouraged to plan early for future hiring needs and consider alternative staffing solutions.
